Australian businesses experiencing genuine skill shortages may be eligible to sponsor overseas workers through a Designated Area Migration Agreement (DAMA) or a Company-Specific Labour Agreement.

These agreements provide flexibility beyond standard skilled visa programs, allowing approved employers to access concessions on occupation lists, salary thresholds, age limits, and English requirements in certain circumstances.

A Designated Area Migration Agreement (DAMA) is a formal agreement between the Australian Government and a regional authority. It allows businesses located in designated regional areas to sponsor overseas workers under more flexible conditions than standard employer-sponsored visas.

DAMA arrangements may provide concessions including:

  • Access to additional occupations not available under standard skilled lists
  • Reduced Temporary Skilled Migration Income Threshold (where permitted)
  • Age concessions for permanent residency pathways
  • English language concessions in certain occupationS 
  • Pathways to permanent residency
     

Each DAMA is region-specific and includes its own occupation list and eligibility criteria.


A Company-Specific Labour Agreement is designed for businesses with unique workforce needs that cannot be met through existing visa programs.

Employers must demonstrate:

  • Genuine and ongoing labour shortages
  • Extensive recruitment efforts within Australia
  • That the requested occupations are critical to business operations
  • Financial capacity to meet sponsorship obligations
     

Labour Agreements are negotiated directly with the Department of Home Affairs and require detailed business justification.


 

The process is structured and evidence-based. It generally involves:

1. Business Eligibility Assessment

We assess:

  • Business structure and operations
  • Location eligibility (for DAMA)
  • Workforce shortages
  • Recruitment history
  • Financial capacity
     

2. Endorsement Application (for DAMA)

Employers must first obtain endorsement from the relevant regional body before applying to the Department.


3. Labour Agreement Negotiation

A formal request is submitted to the Department of Home Affairs, including:

  • Business case submission
  • Workforce projections
  • Evidence of labour shortages
  • Proposed concessions
     

4. Visa Nomination & Application

Once the agreement is approved:

  • Employer nomination is lodged
  • The overseas worker applies for the relevant visa (commonly Subclass 482 or Subclass 186)
